1. WHAT INFORMATION DO WE COLLECT?

Personal information is data about an individual who can be identified from that data, or by combining it with other data. Personal information is usually your name in combination with another identifier, such as postal address, email address, telephone number, or government-issued identification number. Personal information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. We collect personal information when you disclose it to us directly or automatically as described below.

 

Personal information you disclose to us

We collect personal information that you voluntarily provide to us when you interact with us in person, online or by phone or mail to register on the Services as a creator, attend our events, express an interest in obtaining information about us or our products and Services, receive help through our customer support, when you participate in activities on the Services such as participation in customer surveys or contests, or otherwise when you contact us.

 The personal information we collect may include the following:

  • Identifiers, such as a real name, online identifier, IP address, or email address

  • Personal information categories such as a name, telephone number or email address

  • Commercial information, such as records of products purchased, obtained, or considered, or other purchasing or consuming histories or tendencies

 

We may also collect information from you when you sign up as a creator online using account credentials from third-party services such as Google or X (“Single Sign” or “SSO”). If you choose to use SSO, we will receive certain information such as your name, email address, and any other information that you authorize us the provider of the SSO to share with us. We use this information to provide the Services to you and communicate with you. We do not control their privacy practices, so please refer to the terms of use and privacy policy of the SSO. You may disconnect your SSO account from our Services by contacting us.

 

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as the last four numbers on your payment instruction, and the security code associated with your payment instrument. All payment data is handled and stored by Stripe. You may find their privacy notice link(s) here: https://stripe.com/privacy.

 

Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, like your Facebook, X, or other social media account. If you choose to register in this way, we will collect certain profile information about you from the social media provider, as described in the section called "HOW DO WE HANDLE YOUR SOCIAL LOGINS?" below.

 

Information automatically collected

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

 

The  internet or other similar network activity information we collect includes:

 

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).

 

  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

 

  • Location Data. We collect location data such as information about your device's location. How much information we collect depends on the type and settings of the device you use to access the Services. For example, if you opt-in, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

 

Google API

Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.

  • We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments

 

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

 

We may need to share your personal information in the following situations:

§  Service Providers. We may disclose your personal information with our contracted service providers who need access to such data to carry out work on our behalf. This includes companies providing the following services for our Services: hosting, authentication, cyber security, advertising and marketing, and other services to operate our business. 

§  Legal and Compliance. We may also share your Personal information in connection with government or law enforcement requests or in response to investigations, subpoenas, court orders, or other legal processes to: operate these Services, process any orders or registrations, protect the rights or property of Fairground, its affiliates, users, and customers, establish or exercise our legal rights or defend against legal claims, or as otherwise required by law.

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

 

5. DO WE USE COOKIES, PIXELS AND OTHER TRACKING TECHNOLOGIES?

 

We may use cookies, pixels, tags, scripts, SDK, and similar tracking technologies (like web beacons and pixels) (collectively “Trackers”) to gather information when you interact with our Services. Some Trackers help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions, and others help us with advertising, and marketing.

Pixel

Pixels are small transparent images embedded in a site, email or ad and may provide information to platforms, who may combine your information with other information they have about you. We use pixels to automatically collect information when you visit our Services. These technologies usually track advertising preferences from site to site, and gather data about a users’ browsing habits to improve the user experience. You may seek to block tracking pixels by installing a dedicated browser extension or ad-blocking extension for that purpose or by adjusting your browser privacy settings.

 

Google Analytics

Google reCAPTCHA

We use Google reCAPTCHA to protect our Services from spam and abuse. For example, you may be asked to check a box indicating that you are not a robot or Google reCAPTCHA may detect abusive traffic without user interaction. Google reCAPTCHA works by transmitting certain types of information to Google, such as the referrer URL, IP address, visitor behavior, operating system information, browser and length of the visit, cookies, and mouse movements.

 

Manage Opt Out Preferences

You can manage your preferences for Trackers by clicking on “Consent Preferences” at the bottom of our Site. You will not be able to opt-out of any cookies that are “Essential” for the Site. However, you can choose to accept or decline non-essential cookies and Trackers as you wish. If you have accepted non-essential cookies and Trackers by opting in, you can change your preferences at anytime by opting out of such non-essential cookies and Trackers.

 

We also use Trackers from third parties and service providers to provide advertising about our products and services tailored to your interests which may appear either on our Services or on other websites through certain Trackers such as Google Analytics, or Hubspot, if you have opted in. 6. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

 

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

 

Use of AI Technologies

 

We provide the AI Products through third-party service providers ("AI Service Providers"), including Anthropic, OpenAI and ElevenLabs. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

 

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.

 

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

 

8. HOW LONG DO WE KEEP YOUR INFORMATION?

 

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). 

 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. EEA Residents

We will honor your opt-out preferences if you enact the Global Privacy Control (GPC) opt-out signal on your browser.[BS8]  We do not follow other do not track signals.

 

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

 

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

 

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

 

Appeals

We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

 

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?"

 

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Australia and New Zealand
